The MJ Case, the Receipts The Documentary Left Out | Part 5 - The Netflix Doc, and The Cascio's

A viewer in my chat last night asked if I'd seen Megyn Kelly's recent episode, the one where her expert talks about "the books they found at Neverland." Others said people had told them there were "pictures of naked children." So tonight we do what we always do on this channel. We stop arguing about what we heard and we go read what's actually in the record. The Robson and Safechuck cases are still pending. Those plaintiffs are entitled to due process, and so is everyone else in this story. What I'm here to do is pull the actual paper, the 2005 trial transcript, the Santa Barbara Sheriff's inventory, the 333-page FBI Vault file, the California Supreme Court docket, and show you where the viral version and the record part ways. Because they part ways a lot. We start with Megyn Kelly's "expert," attorney and journalist Andrew Hammel, and his Quillette piece "Never Neverland." I'll tell you exactly what his segment claims and exactly what tier of source it is, then we test it against the primary record instead of taking it on faith. Then the books. There were two Neverland searches, 1993 and 2003, and two art-photography books actually went in front of the 2005 jury. I'm going to name them, put them on screen, and read you Thomas Mesereau's filed motion language about prosecuting a man for owning legal books. Two things are true at once here, and we're not going to pretend otherwise. These books existed and Michael Jackson owned copies. That's not in dispute. And possessing controversial-but-legal art books is not the same legal category as child sexual abuse material. The jury heard the prosecution's grooming theory. They acquitted on fourteen counts. We'll talk about what that does and doesn't mean. Then the part that almost never makes the cable segments: the FBI file. The Bureau's forensic team examined sixteen hard drives seized from Neverland. Zero CSAM. Zero federal sex charges ever recommended. Zero indictments. Two investigations, both closed. The viral claim that the FBI file "confirmed" anything is, on the actual document, backwards. Then the big one. The "naked children pictures" claim that recycles every couple of years. We trace it back to the 2016 Radar Online cycle, and I'll read you, on the record, what the Santa Barbara Sheriff's Office told the LA Times about those documents and what the Estate told Snopes. The caveat is the whole story. And then the live legal fight, because this one is moving right now. The Cascio family, Michael's self-described "second family" for 25 years. Frankie's 2011 book. The 2010 "Michael" album and the three Cascio tracks his own siblings said weren't his voice. The Vera Serova consumer-fraud case all the way up to a unanimous California Supreme Court reversal in 2022. And the current arbitration, where the Estate alleges a civil extortion scheme, a $213 million demand dropped to $44 million, and Mark Geragos, the same lawyer who once defended Michael Jackson, now sitting on the other side of the table. I'm going to read you the Estate's allegations as allegations, not as findings, and tell you exactly what I'm watching for next.
