It has been held that it should not include legal arguments or precedents. ​2. Smt. Savitrabai v. Smt. Radhabai (1976) – Karnataka High Court ​In this case, while explaining Order\ 19,\ Rule\ 3 ​​of the CPC, the deponent in an affidavit should state only the facts known to him directly. There is room for discussing points of law and pointing out precedents only at the stage of arguments. It has been held that including them in an affidavit is against the procedure of law. ​3. Quamarul Islam v. S.K. Kanta (1994) – Supreme Court ​In this case, it was held that "Pleadings and affidavits should contain only facts. Law and judgments are to be interpreted by the court and argued by the lawyers. They should not be made the subject matter of the petition."
