How Hedley Byrne changed contract and tort law- Derry v Peak and the Misrepresentation Act.
In this video I explain how the House of Lords' decision, Hedley Byrne v Heller impacted English contract and tort law. I explain the principle held under Candler v Crane [1951], and how this was changed as a result of the decision in Hedley Byrne v Heller. In the Hedley Byrne v Heller 1964 House of Lords' judgment, their Lordships explained that there was a misunderstanding of Derry v Peak (1889) and clarified what the law was. I explain what the misunderstanding was and how their Lordships said the case should be understood. The Misrepresentation Act 1967, and how it is used with cases previously dealt with by application of the Hedley Byrne principles, is also explored.
