If Defense Offers You $10,000 Against a Case That is Worth $500,000 Is That a Serious Offer? When they make a starting offer of $10,000, I know exactly what I walked into. I know immediately what's going on. I know the defense has no intention of trying to settle the case. I realize the defense looks at this in a different hemisphere than we are in. We are nowhere in the same universe. That's unfortunate, because I took them at their word that they were serious about trying to settle this case. Could this just be posturing? Could this initial offer mean there's a lot more? Unlikely. A starting offer of $10,000 tells me that the person I'm dealing with has no authority to settle this case. It's insulting. It's upsetting to my client. It's outrageous. It's a total waste of our time. If instead, they started settlement negotiations at $250,000, then I could suggest that they have a real interest in trying to settle the case. Then we'd get down to really negotiating. Having a real discussion about my clients injuries and about his limitations and disabilities. About the pain he has endured up till now. About his lost earnings. About the medical care and treatment he will need in the future. About the rehabilitation he will require after the multiple surgeries.
