Basi sa section 31 on the Supervision of Real Estate Salespersons paragraph 2 No salesperson shall be entitled, to receive or demand a fee, commission or compensation of any kind from any person, other than the duly licensed real estate broker who has direct control and supervision over him, for any service rendered or work done by such salesperson in any real estate transaction. Ayon sa batas, si licensed real estate broker lang ang may karapatan na tumanggap or humiling ng commission kahit na ang nagtratrabaho or ang naka close ng sale ay ang salesperson. Meaning, walang karapatan ang salesperson na kumuha ng commission directly sa developer or sa ibang tao. Bakit si Broker lang? Dahil ang salesperson ay nagtratrabaho under the accountability, and supervision of a licensed real estate broker. Let’s discuss more. Paano yung commission sharing between the licensed broker at nang saleperson? In project selling, the usual commission rate given by developers is 5%. And usual starting commission rate of a new real estate is 2.5%. So ano mangyayari sa kalahati na commission? Pupunta ito sa broker mo. So sasabihin mo naman na ang laki naman ng commission ni broker eh ako yung nagpakahirap mag close ng sale. So, let’s put aside emotion first and look at it objectively. Walang license ni real estate broker equals colorum- bawal yun at pwede ka pang makulong ng hindi bababa sa 4 na taon. And aside from the license, may office and staff din ang broker mo, gaya ng accountant at runner na kailangan sweldohan para mag manage ng ibat ibang real estate transactions like pagkuha ng commission mo sa developers office at pag compute ng tax para ang ibibigay sayo na rate ay malinis na. At nagbibigay pa ang broker mo ng free training and seminars para maging successful ka sa real estate. Kadalasan may free snacks pa at pa raffle. Kahit nga sa panahon ng pandemic ay nag oonline training pa rin para continuous learning parati. But wait here’s more. At good news ito para sayo. Hindi habang buhay ka na 2.5% lang ang commission mo. Ito ay mag depend sa performance mo in relation ng target or goal ma as a salespersons. Kasi ang mga realty company ay nag incentivize din sa mga agents nila para mas ganahan sila mag trabaho para lumaki ang commission rate nila.
