Share the legitimate fight against Brasília's "untouchables" 👆🏼 Because of a satire with puppets, Gilmar Mendes filed a criminal complaint against the former governor of Minas Gerais, @romeuzemaoficial, and petitioned for his inclusion in the 'Fake News Inquiry' - an investigation conducted by the Supreme Court, in which the alleged victims are the judges themselves, in a process that has already lasted 7 years, was considered unconstitutional by 2 Attorneys General of the Republic, and whose closure has even been requested by the Brazilian Bar Association. Currently, the 3 main newspapers in the country, Globo, Folha and Estadão, are unanimous in their criticism of the Inquiry and its abuses: 🗞 According to Estadão, Brazil has been living for "7 years of exception," and the inquiry has become an "instrument of personal power," which "exposes the deterioration of the STF." 🗞 According to Folha de S.Paulo, we live in the “Republic of the Supreme Court that can do anything.” The law only applies “to other citizens,” and even then, it is “the law as interpreted by the ministers.” 🗞 In turn, Globo published an article titled “The Supreme Court Justices,” with the following highlight: “Now it is no longer an authoritarian government that threatens the Supreme Court, it is the Supreme Court that threatens democracy.” On his social media, Zema made a point of acknowledging that the shoe fit: “Today, those who consider themselves untouchable no longer tolerate any kind of joke. The name of the series my team made is precisely ‘The Untouchables.’ And with this attempt to persecute me, they show that they are exactly that.” ⚖️ But what does the law say? In addition to all the constitutional protection of freedom of expression, Article 359-T of the Penal Code is clear: “Critical expressions against constitutional powers do not constitute a crime (against the Democratic Rule of Law).” In other words, there is no attack on democracy when the Judiciary, the Supreme Federal Court, and even less so the conduct of a judge is criticized.
