What is Non-Criminal Rehabilitation? Non-custodial rehabilitation is the primary punishment applied to offenders of minor or serious crimes. Among the punishments, this form of punishment is lighter than imprisonment but heavier than fines and warnings. How is non-custodial rehabilitation applied? – Non-custodial rehabilitation is applied for a period of 6 months to 3 years to offenders of minor or serious crimes as defined by the Criminal Code, who have stable employment or a clear place of residence, if it is deemed unnecessary to isolate the offender from society. If the convicted person has been detained or remanded in custody, the time spent in detention or remand is deducted from the non-custodial rehabilitation sentence; one day of detention or remand is equivalent to three days of non-custodial rehabilitation. – The court assigns the person sentenced to non-custodial rehabilitation to the relevant agency; The organization where the person works or studies, or the People's Committee of the commune where the person resides, is responsible for supervising and educating them. The family of the convicted person is responsible for cooperating with the agency, organization, or the People's Committee of the commune in supervising and educating that person. – During the period of serving the sentence, the convicted person must fulfill certain obligations according to the regulations on non-custodial rehabilitation; and a portion of their income, from 5% to 20%, will be deducted and contributed to the state fund. Income deductions are made monthly.
