Italian Citizenship Legal Breakdown: Why We Won in Palermo

In this video, I break down a recent Italian citizenship by descent judgment obtained by our law firm before the Court of Palermo. In the previous video, I shared the news that the court recognized Italian citizenship in a case filed after the 2025 citizenship reform and decided after the Constitutional Court ruling. Today, we go deeper. This is a full legal breakdown of the Palermo decision: what the judge said, how the court addressed Law 74/2025, how the court discussed Article 3-bis, and why the applicant’s pre-reform activity became so important. The key issue is not simply Italian ancestry. After the 2025 reform, the real question is whether the applicant’s position had already become legally meaningful before the new law changed the rules. In this judgment, the court recognized that the applicant had already entered the citizenship process before the reform and could not be treated in the same way as someone who had remained completely inactive. In this video, I explain: why this case matters after Law 74/2025; how the Court of Palermo dealt with the Constitutional Court decision no. 63/2026; why the judge did not ignore the reform; why the concept of a “sufficiently consolidated” position is so important; how the court approached consular delays and access to justice; why evidence of pre-reform activity can be decisive; what this may mean for ATQ / denial of justice cases; why 1948 cases require a different analysis; and why every case still needs a careful legal assessment. This decision does not mean that every post-reform case will win. It does not mean that Law 74/2025 no longer applies.
