If your agricultural land is located in the interior and you have no proper access road, the law recognizes your right to pass through another person’s land for convenient use of your own land. 1. What is Easement Right? An Easement means the right to use another person’s property for a specific purpose — like walking, driving a tractor, irrigation pipeline, drainage, or transporting produce. 2. Right of Way (Way of Necessity) If your land is landlocked (no direct road), you can claim a “Way of Necessity” under the Act. This means the neighbor must allow access so you can cultivate, enter, or take out crops. 3. How to Access Your Agricultural Land Legally? ✔ Step 1: Try Mutual Consent Talk to the neighboring landowner and request a passage. Most issues resolve through discussion. ✔ Step 2: Village Revenue Authorities If there is no settlement, approach the following officials: Village Revenue Officer (VRO) Tahsildar / Mandal Revenue Officer Survey Department They will verify maps, old paths, and recommend a pathway. ✔ Step 3: File a Complaint in Meekosam / PGRS You can submit a grievance under the category Land Matters / Right of Way. Officials will: Conduct field inspection Check land records & FMB sketches Suggest or assign a pathway (Cart Track / Rasta) ✔ Step 4: Civil Court Remedy If local authorities fail to resolve, you can approach a Civil Court for granting Easement Right. Mention blocked access, cultivation difficulty, or old rasta closed. Request for survey & demarcation.
