JAKARTA, KOMPAS.TV - Former Deputy Chairman of the Corruption Eradication Commission (KPK) from 2003 to 2007, Amien Sunaryadi, believes that law enforcement officials need to clearly distinguish between policy errors and criminal acts of corruption. According to him, the main difference lies in the presence of malicious intent or corrupt acts such as bribery and extortion. Amien cited the ASDP case as an example that, he believes, demonstrates the potential for criminalization of policy. According to Amien, the assessment of a policy should focus on whether or not there was malicious intent on the part of the official making the decision. Amien also cautioned that the use of the state loss article has limitations, especially when authorities want to pursue assets obtained from crime abroad. He believes a more effective approach is to follow the flow of the proceeds of crime, or "follow the money," so that all profits obtained from the crime can be confiscated by the state.
