What is a patent attorney? - Training, work, salary, requirements https://rolfclaessen.com - Subscribe to the channel: https://www.youtube.com/subscription_... #rolfclaessen A patent attorney specializes in, and is limited to, advising on patents, trademarks, and designs. While a lawyer completes a very broad legal degree with the state examination, a patent attorney is typically an engineer or natural scientist, such as a chemist, biologist, or physicist, with a master's degree or diploma from a university. Why is this? Patent attorneys need to have a very good understanding of the inventors' inventions in order to secure the best possible protection for them. For example, if an inventor has invented a new ceramic material or a hair shampoo, I, as a chemist and materials scientist, can understand that much better than an invention of a new electric motor. Afterward, one becomes a so-called patent attorney candidate and usually completes a 2-3 year training program with a licensed patent attorney. During their training, patent attorneys demonstrate, using daily practice, how to register and enforce patents, trademarks, and designs, how to handle licenses, and how to advise companies on employee invention law. Alongside their practical training, patent attorney candidates must complete a two-year distance learning program at the Open University of Hagen, which is specifically tailored to the needs of patent attorneys. This program covers topics such as the German Code of Civil Procedure (ZPO) – including court proceedings – as well as contract law and competition law. Criminal law and constitutional law are almost entirely absent from this program, as these areas of law are rarely relevant to patents, trademarks, and designs. Following the training period with a patent attorney, candidates complete a training period at the German Patent and Trademark Office and the Federal Patent Court. Here, they learn about the work of trademark and patent examiners and also gain insight into the work of judges at the Federal Patent Court. Furthermore, patent attorney candidates attend lectures and write practice exams during this period, which provide excellent preparation for the final examination. After passing the final examination at the German Patent and Trade Mark Office, the patent assessor can then establish a practice as a patent attorney in Germany. Admission to the European Patent Office is also important for patent attorneys. The examination for this takes place once a year and has had a fairly consistent failure rate of around 70% for many years. This examination can be retaken. However, statistically speaking, the probability of passing the exam does not increase with each retake. Due to their specialization in patents, trademarks, and designs, and the technical specialization gained from their prior studies in engineering or natural sciences, lawyers in patent infringement cases typically work in teams with a patent attorney. The patent attorney is usually better able to grasp the technical aspects and can thus make a crucial contribution to the success of such a patent infringement case.
