An agreement to sell, on the other hand, is a contract where the parties agree that a sale will take place at a future date, subject to fulfillment of certain conditions. Here, the ownership is not transferred when the agreement is made. It is only upon fulfillment of the agreed terms at the specified future date that the sale will materialize and the ownership gets transferred. The agreement to sell is typically not a completed sale until the terms of the contract are fulfilled, at which point the sale is said to be "consummated."
