Joint property is one of the legal forms permitted by our legal system for developing a business project, but it has a series of characteristics that define it. What is a joint property? A joint property is simply an agreement between two or more people, usually self-employed individuals, who share a property asset, which, as established in Article 392 of the Civil Code, must be an undivided asset between several people. This legal form does not have its own legal personality; it does not hold rights and obligations; the partners assume full responsibility for them. The lack of its own legal personality means that the partners, in this case called co-owners, have personal, unlimited, subsidiary, and joint liability for the debts and obligations of the joint property. It is governed by the Civil Code for its definition, rights, and obligations, and by the Commercial Code for the commercial aspect.
