Granada, August 10 (EFE) - The legal representatives of Juana Rivas, the woman who has been unreachable since two weeks ago, violating the order to return her children to their father, have again filed an appeal for protection before the Constitutional Court (CC) seeking a precautionary suspension of the two children's return. This was announced by Francisca Granados, director of the Equality Department of Maracena (Granada) and legal advisor to the center where Rivas attended since moving to Spain in 2016, who explained that the appeal for protection now has a registration number. Attorney Almudena Mendonza, a lawyer with the Montero Estévez firm representing Rivas, confirmed to EFE that the appeal for protection has been filed to request a precautionary suspension of the execution of the judgment ordering this mother to return her children to her ex-partner, Francesco Arcuri, who resides in Italy. This new appeal to the Constitutional Court, partially accessed by Efe, requests that the execution of the ruling be suspended as an "extremely urgent" measure and argues that the protection of the children, aged three and eleven, "deserves the most absolute protection of the court," an aid that it notes "has been denied by the ordinary courts and tribunals." The request to the high court was formalized after the Fifth Section of the Granada Court announced today that it is rejecting the exceptional motion for annulment filed by Rivas, against whom a warrant for her arrest and transfer to court has been in place since Tuesday. Francisca Granados explained that she would have preferred a different ruling and again cited "fundamental humanitarian reasons that are in line with the best interests of the minors" to request that the order to hand over the children be annulled. At a press conference, the legal advisor of the Maracena Women's Center expressed her disagreement with the provincial court, although she said they maintain "hope" in the Spanish judicial system and in the Constitutional Court, which she asked to restore "the fundamental rights that have been violated." She stated that "all our hopes" are placed on the Constitutional Court as a way to resolve "all the irregularities" that she believes have occurred during the more than year-long case. "The interests at stake are so important that we are requesting an extraordinary and urgent precautionary measure to suspend the execution," Granados reiterated, adding that there is no deadline for the Constitutional Court to rule, but that she has planned to expedite the adoption of measures due to the relevance of the case.
