Many states have strong Corporate Practice of Medicine laws and restrictions. In many states anyone can own a medical spa directly. Some states such as New York, California, and Texas have strong CPOM restrictions. In these states physicians, or other licensed healthcare providers, may only provide medical services through a professional corporation owned by medical professionals that are licensed in that state. In the stricter states, the states that restrict CPOM, a non physician, can get into the medical spa business through a management company or management service. Some states have CPOM restrictions, and some do not, but it might be focused on other areas such as dentistry, optometry, etc. The good news is, if you do form that management services organization, it may apply in different context.
