REGULATIONS GOVERNING SELF-EMPLOYMENT PERMITS The Temporary Residence and Work Permit for Self-Employment is regulated by the following legislation: Organic Law 4/2000, of January 11, on the Rights and Freedoms of Foreigners in Spain and their Social Integration (Articles 25 bis, 36, and 37). It is a temporary residence and work permit for a non-resident foreigner in Spain to carry out a self-employed professional activity. REQUIREMENTS FOR SELF-EMPLOYED RESIDENCE PERMIT Not be a citizen of a European Union Member State, a State of the European Economic Area, or Switzerland, or a family member of citizens of these countries to whom the Union citizen regime applies. Not be illegally present in Spanish territory. Have no criminal record in Spain or in previous countries of residence for offenses recognized under Spanish law. Not be prohibited from entering Spain and not be listed as inadmissible in the territory of countries with which Spain has signed an agreement to that effect. Not be within the period of commitment not to return to Spain that the foreigner assumed upon voluntarily returning to their country of origin.
