Teacher Eligibility Test (TET) has become one of the most important qualifications in the Indian education system for teachers who want to teach classes I to VIII. The requirement of qualifying TET was introduced after implementation of the Right of Children to Free and Compulsory Education Act, 2009 (RTE Act). Under Section 23 of the RTE Act, NCTE was authorized to prescribe minimum qualifications for teachers. Accordingly, on 23 August 2010, NCTE issued notifications making TET mandatory for elementary teacher appointments. The objective behind introducing TET was to ensure teachers possess proper subject knowledge, teaching skills and pedagogical understanding required for quality education. However, implementation of TET requirements also created multiple legal disputes involving: • Minority Educational Institutions • In-service teachers appointed before TET existed • Questions regarding constitutional protections • Applicability of TET requirements in different situations Some minority institutions argued that compulsory TET interferes with constitutional protections under Article 30, while authorities argued that maintaining educational standards remains essential. Another major issue involved in-service teachers appointed years before TET existed. These teachers argued that since TET did not exist at the time of appointment, it should not become mandatory later for continuation or promotion.
