Federal Law No. 15,326/2026, enacted on January 6, 2026, is a historic milestone as it corrects a huge distortion in the valuation of early childhood education professionals in Brazil. The law formally includes early childhood education teachers (daycare centers and preschools) in the public teaching career, guaranteeing them the same rights and benefits as elementary and high school teachers. SUMMARY IN THE VIDEO: The law amends the Law of Guidelines and Bases of Education (LDB) and the Minimum Wage Law to guarantee that early childhood education teachers have the right to: National Minimum Wage: They must receive, at a minimum, the amount established annually by the government for teachers. Career Plan: They must be included in the same job and salary plans as other levels of basic education. Working Hours: Right to fulfill the working hours with a 1/3 reserve for activity hours. Special Retirement: Formal recognition as a teacher ensures the right to the differentiated retirement rules for teachers. BUT PAY ATTENTION TO THE CRITERIA: To be covered by the law and included in the career path, the professional needs to: Work directly with children (daycare or preschool). Possess the minimum required education (Normal/Teacher Training course at the secondary level or higher education degree in Pedagogy/related field). Have entered the teaching position (or equivalent) through a public competitive examination. But note: teaching position IS DIFFERENT from support activities. The law does not automatically transform support positions into teaching positions. It focuses specifically on those who already perform the pedagogical function.
