90% saem sem processo: como eu desocupo um imóvel de leilão
I won an auction for an apartment with a family living inside—and the resident told me to my face: "I'm not leaving, Caixa couldn't auction it off, I know my rights." In this video, I show exactly what I did. I take you inside a real eviction case in Jacareí, in the Paraíba Valley: from the first notification to the judge's decision. I explain why I prefer occupied properties, the myths that fool almost everyone (family's only property, illness, children), what Law 9.514/1997 (fiduciary alienation) says, why this is NOT an eviction but rather an order to take possession, how much it costs, how long it takes, and why in 90% of cases the person leaves through negotiation—often leaving better off than when they entered. At the end, I tell you how this case really ended. 👉 Comment "LIST" below and I'll send you the step-by-step eviction process. ❓ QUESTIONS THIS VIDEO ANSWERS • Is it possible to remove the person living in the auctioned property? Yes: most of the time by agreement, and when that doesn't work, through a court order for possession. • Can a family's only property go to auction? In an extrajudicial auction, yes, because the property belongs to the bank (fiduciary alienation, Law 9.514/1997) — the resident only has possession. • Is vacating an auctioned property the same as eviction? No. When you win the auction, the correct process is called a court order for possession, and it's easier. • How much does it cost to vacate an auctioned property? Generally around R$4,000 to R$5,000 for a lawyer plus 1% in court costs — something around R$6,000. • How long does it take? In São Paulo, it usually takes around 60 days; with an injunction, it's much faster. • Does having a child, illness, or disability prevent eviction? It doesn't — these are myths; The decision rests with the judge, but the law already defines how the auction must proceed. ━━━━━━━━━━━━━━━━━━━━━━━━━ 🔗 USEFUL LINKS 🏠 ArremaAí: https://arremata.ai/ 📩 Newsletter (Substack): https://edwardsmiranda.substack.com 📸 Instagram: / euedwardsmiranda ━━━━━━━━━━━━━━━━━━━━━━━━━ ⏱️ CHAPTERS 00:00 The property with the family inside 00:46 Why I prefer occupied property 02:45 The myths of eviction 04:25 Law 9.514 that changes everything 05:57 The Jacareí case 06:20 Notifying and trying to reach an agreement 07:41 "I'm not leaving, I have my rights" 09:26 When the negotiation ends 10:44 Taking possession is not eviction 11:42 Deadlines and injunctions 13:41 90% leave without a lawsuit 14:40 Occupancy fee and lawyer 16:58 How the case ended 17:59 Why the person leaves best ━━━━━━━━━━━━━━━━━━━━━━━━━ #realestateauction, #bidnow, #edwardsmiranda, #auction, #auctionproperties, #realestateinvestment, #properties, #judicialauction, #extrajudicialauction, #purchase, #realestateinvestor, #passiveincome, #eviction, #propertypurchased, #possession, #legalaction, #fiduciaryalienation
