Marco Jurídico de la ASAMBLEA EXTRAORDINARIA en Propiedad Horizontal

Legal Framework for the EXTRAORDINARY ASSEMBLY in Horizontal Property ARTICLE 39. MEETINGS. The General Assembly shall meet ordinarily at least once a year, on the date indicated in the horizontal property regulations and, without notice, within three (3) months following the expiration of each budget period; to examine the general situation of the legal entity, make the appointments for which it is responsible, and consider and approve the accounts for the last fiscal year and the budget for the following year. The meeting shall be called by the administrator, with no less than fifteen (15) calendar days' notice. Extraordinary meetings shall be held when unforeseen or urgent needs of the building or complex so warrant, upon convening by the administrator, the board of directors, the Statutory Auditor, or a plurality of owners of private property representing at least one-fifth of the co-ownership coefficients. PARAGRAPH 1. All meetings shall be called by means of a notice sent to each of the owners of the privately owned property in the building or complex, to the last address registered by them. In the case of extraordinary meetings, meetings held remotely, and decisions made through written communication, the agenda shall be included in the notice, and decisions may not be made on matters not covered therein. PARAGRAPH 2. The notice shall contain a list of the owners who owe contributions to common expenses. ARTICLE 40. MEETINGS BY RIGHT. If the meeting is not called, it shall meet as an ordinary meeting, by right, on the first business day of the fourth month following the expiration of each budget period, at the place and time indicated in the regulations, or failing that, at the premises of the building or complex at eight past noon (8:00 p.m.). Any meeting held on any day, time, or place without prior notice shall also be valid when the participants represent all of the co-ownership coefficients of the building or complex, without prejudice to the provisions of this law for the purposes of qualified majorities. ARTICLE 41. SECOND CALL MEETINGS. If the general assembly of owners, once called, cannot meet due to a lack of quorum, a new meeting shall be called on the third business day following the initial call, at eight past noon (8:00 p.m.), without prejudice to the provisions of the horizontal property regulations. The meeting shall meet and make decisions validly with a plural number of owners, regardless of the percentage of coefficients represented. In any case, the call provided for in the previous article must record the provisions of this article.
