Nova portaria do Ministério do Trabalho muda regras para funcionamento em feriados

The new Ministry of Labor decree alters the rules for the operation of businesses on holidays and requires companies to pay closer attention to collective bargaining agreements. With this change, many establishments will no longer be able to unilaterally decide whether to open on these days, and will now depend on negotiations between employers' and workers' unions. In an interview with Jornal Anhanguera 2ª Edição, Ana Luísa Santana, partner at Lara Martins Advogados and a lawyer specializing in Labor Law and Labor Procedure, explained that the new rule now covers a large part of the retail sector, including street shops, shopping malls, supermarkets, and hypermarkets. Only activities considered essential, such as pharmacies, gas stations, hotels, and restaurants, remain authorized to operate normally without this negotiation. The specialist emphasizes that the measure requires more strategic planning on the part of business owners, who should monitor the collective bargaining agreements of their category before deciding on holiday operations. Compliance with these rules is fundamental to ensuring legal security for companies and avoiding operational and financial impacts.
