At the end of October last year, the National Security and Defense Council of Ukraine, chaired by President Volodymyr Zelensky, held a meeting at which it considered the situation regarding corruption and other offenses when establishing disability for officials of state bodies. In accordance with the NSDC decisions, the government approved a plan of measures to combat corruption and other offenses when establishing disability for officials. According to this plan, the Ministry of Health created a joint interdepartmental working group with law enforcement officers to verify the validity of decisions of medical and social expert commissions (MSEC) on establishing disability for officials of state bodies. The group, according to information from the SBU, the State Bureau of Investigation and the Prosecutor General's Office, formed a list of 2,636 cases of officials from over 70 state bodies for verification. Among them, 31% (816 people) are cases of employees of the State Customs Service, 20% (518 people) are employees of the State Tax Service of Ukraine, and 17% (448 people) are employees of the prosecutor's office and others. The review of cases of officials is carried out by experts of the Ukrainian State Scientific Research Institute of Medical and Social Problems of Disability of the Ministry of Health of Ukraine in the city of Dnipro. As of February 17, 2025, experts received 2,636 cases from the list, of which 1,359 have already been processed. As a result of the inspections, in 281 cases, the decisions of the MSEK were canceled: 73 canceled decisions concern officials of the State Customs Service, 67 - of the State Tax Service of Ukraine, 50 - employees of the prosecutor's office. Experts inform law enforcement agencies and the Ministry of Health about the results of the inspections. Also, new decisions have been made in 232 cases (the disability group of 160 persons was changed and the validity period of 72 persons was changed). Currently, another 466 officials have been summoned for examination to make a decision. Prosecutors of the General Inspectorate of the Prosecutor General's Office, during the investigation of criminal proceedings into the facts of illegal receipt of disability groups by officials of the prosecutor's office of various levels, reported suspicion of fraud to two prosecutors (Part 4 and Part 5 of Article 190 of the Criminal Code of Ukraine). Also, two officials of medical and social expert commissions were reported suspicion of official forgery (Part 1 of Article 366 of the Criminal Code of Ukraine). Resolution of the Cabinet of Ministers of Ukraine 1338 (link to the resolution: https://zakon.rada.gov.ua/laws/show/1...) defines the following: clause 3. - Persons whose disability has been established without specifying the term for a re-examination shall undergo an assessment of daily functioning at their own request (at the request of a guardian in the event of deprivation of legal capacity of a person with a disability) or by court decision. 51. The Center for Assessment of the Functional State of a Person shall verify the validity of decisions made during the assessment and/or made by medical and social expert commissions: in execution of a resolution of an investigator, prosecutor, or a resolution of an investigating judge regarding a person specified in the resolution of an investigator, prosecutor, or a resolution of an investigating judge; at the request of the working group for ensuring the implementation of monitoring in the field of assessing the daily functioning of a person, formed by the head of the regional, Kyiv city state administration (military administration) (hereinafter referred to as the monitoring working group); according to the results of the monitoring of the assessment, the implementation of which is ensured by the Center for the Assessment of the Functional State of a Person.
