The administrative material was sent to G.G. Inspector Fomin scheduled an administrative investigation for May 8. When I went into Fomin's office, I felt like I was being accused of some kind of crime. Since the inspector behaved very aggressively towards me and said that I was to blame for the accident, showing some printed screenshots on A4 paper. In these screenshots, it was clear that the fronts of the cars were side by side, although the rear right side of the car was damaged in the collision. After a while, I decided to take my phone and record the whole process on video, as I was afraid of illegal actions in my direction and I wanted the administrative investigation to take place without violating my rights, that is, I hoped that video filming would somehow discipline employees police. At that moment, the inspector began to draw some incomprehensible marking lines, which actually do not exist at the accident site. It's stupid in my opinion because it doesn't make any sense. Based on his crazy theory, the traffic police inspector tried to accuse me of violating traffic rules and find me guilty of an accident. Before that, I repeated several times that there was a diagram of the accident, photos and video from the scene of the accident, the inspector did not hear me. In the process of filming, Inspector Fomin said that he forbade me to film, although in this case his permission was not required, since at the time of filming an administrative investigation was underway. That is, Inspector Fomin made an illegal demand. Some time later, Inspector Afonin turned to me with the same illegal demand to stop filming, without introducing himself before that, as required by paragraph 4 of article 5 of the Federal Law on the Police. Moreover, Inspector Afonin threatened to bring me to administrative responsibility for failing to comply with the lawful request of a police officer. I had to obey the illegal demand of inspector Afonin and Fomin, and I turned off my mobile phone camera. I believe that they exceeded their authority and violated my constitutional rights and the law on the police. Fomin and Afonin referred to Part 3 of Art. 24.3 of the Code of Administrative Offenses of the Russian Federation, thereby misled me, replacing the concepts of considering an administrative case with an administrative investigation. These are different procedures. Below I am enclosing a memo of the Voronezh regional public movement "Road Control", where this situation is fully analyzed, which is based on the current regulatory legal acts. A few minutes later, I turned on the audio recording and, in the process of talking with the inspectors, decided that I needed to file a petition for the appointment and conduct of an autotechnical examination, since the expert would accurately establish my innocence. I asked Inspector Fomin for a pen and began to write a petition. A minute later, Fomin revised his crazy idea about my guilt and I turn out to be innocent. He nevertheless decided to get acquainted with the scheme of the accident and other evidence that I attached to the case file and finally finds me not guilty. After that, Fomin asks us to leave the office in order to draw up a protocol and a decision on an administrative offense. A few minutes later, Inspector Fomin invited us into the office and gave me copies of the protocol and the resolution. When I left the office, the second participant in the process remained and expressed something to Inspector Fomin. In my opinion, I believe that Inspector Fomin promised to "resolve" this dispute in favor of the second participant in the accident, but they did not succeed.
