#harbourmaster'soffice #spearfishing #underwaterfishing 2026 REGULATORY COORDINATION ON BEACH SAFETY Users and the freediving community are informed that, following a fruitful institutional dialogue and the formal request submitted by F.I.P.I.A. on May 18, 2026, the Genoa Harbour Master's Office - Coast Guard has proceeded with the necessary integration and revision of the consolidated text on bathing regulations. Through the issuance of the subsequent Supplementary Ordinance No. 97/2026 (dated May 27, 2026), the Maritime Authority has coordinated the provisions of the previous Ordinance No. 40/2026, fully accepting the concerns raised by the Federation for the protection of sport and recreational freediving. REGULATORY FRAMEWORK AND LEGAL REFERENCES: The request submitted by FIPIA, formally accepted by the Port Authority in the exercise of its coordination powers, restored the correct legislative framework based on the hierarchy of sources and the following pillars of maritime law: Presidential Decree No. 1639 of October 2, 1968 (Regulation for the implementation of Law No. 963 of July 14, 1965 on the regulation of marine fishing) and subsequent amendments and additions (as amended): primary regulatory framework governing underwater fishing activities and distances at the national level, overriding local regulations. Legislative Decree No. 1639 of January 9, 2012 4 (Measures for the reorganization of fishing and aquaculture regulations): a key text defining the rights, duties, and legality associated with freediving, as well as the mechanisms for implicit or explicit repeal of previous conflicting regulations. Article 20 of the Consolidated Law (CP Genova): Reformulated and integrated by Ordinance No. 97/2026. The new wording effectively repeals the previous unlawful restrictions contained in Act No. 40/2026, implementing FIPIA's administrative request/appeal and definitively authorizing spearfishing within the limits established by state law, while simultaneously ensuring bathing safety. This extraordinary result demonstrates how technical collaboration with institutions is the most effective tool for enforcing the rights of freedivers, in full compliance with the law and ordinances in force in the Maritime District of Genoa (from Cogoleto to Camogli).
