St. Maczka 4, 35-234 Rzeszów Rzeszów, on November 9, 2020 Rz-PPR-B.450.554.2020.2 In reference to your letter sent electronically to the National Labor Inspectorate – District Labor Inspectorate in Rzeszów (received on October 7, 2020), I hereby inform you: Due to the current epidemiological situation, the Act of March 31, 2020, amending the Act on special solutions related to the prevention, counteraction, and combating of COVID-19, other infectious diseases and crisis situations caused by them, and certain other acts (Journal of Laws, item 568), entered into force on March 31, 2020, providing, among other things, special solutions for foreigners in Poland. The introduced regulations will enable individuals who wish to pursue their current purpose of stay or are unable to leave Poland due to the spread of the SARS-CoV-2 virus to legally remain in the country. The key provisions of the introduced regulations stipulate that: • the legal stay of foreigners based on national visas and temporary residence permits, which would expire during the state of epidemic threat or epidemic, • the validity periods of residence cards and temporary foreigner identity certificates, • the deadline for submitting applications for stay legalization, • the validity of already issued work permits, seasonal work permits, and declarations of entrusting work to a foreigner - are extended until the 30th day following the date of lifting the state of epidemic threat or epidemic, depending on which of these states was last in force. The extension of legal stay/application deadline/validity of already issued permits applies to situations in which the last day of legal stay/application deadline/permit validity falls during the state of epidemic threat or epidemic (i.e., from March 14, 2020). The extension of a foreigner's legal stay also applies to foreigners holding short-term residence permits (including Schengen visas and visa-free travel). Extending a temporary residence permit and a national visa does not require replacing the residence card or affixing a new visa sticker. Furthermore, similar to the above, the deadlines for: • foreigners to leave Polish territory, • voluntary return specified in decisions obliging the foreigner to return, will be extended. National visas are long-term visas issued exclusively by Polish authorities, authorizing entry into the territory of the Republic of Poland and continuous stays there, or several consecutive stays there, lasting longer than 90 days. The validity period of a national visa cannot exceed one year (Article 59 of the Act on Foreigners). The special law stipulates that if the last day of stay based on such a visa (and therefore the last day of the permissible stay indicated in days on the visa sticker) falls during a period of epidemic threat or state of epidemic, this period, as well as the validity of the visa itself, is extended by operation of law until the 30th day following the revocation of the last state of epidemic threat. Therefore, the right to stay in the territory of the Republic of Poland is extended by operation of law. No administrative decision is issued for this to occur. In such a case, no visa extension is granted under Article 82 et seq. of the Act on Foreigners. The period of stay considered legal will begin on the day following the last day of legal stay based on visas, residence permits, or visa-free travel and will last until the 30th day following the date on which the state of epidemic threat or state of epidemic threat (the last state of epidemic threat) is lifted. The exercise of this right is dependent on the foreigner's continued stay in the territory of the Republic of Poland. Departure from the territory of the Republic of Poland will result in the loss of this entitlement. Therefore, to re-enter Poland, they will need to re-obtain the appropriate residence permit. Foreigners whose stay in the territory of the Republic of Poland is considered legal in accordance with Article 15z1, Section 1 of the Special Act are entitled to work in Poland provided they have a valid work permit or a valid seasonal work permit, or a declaration entered in the register maintained by the relevant district labor office (taking into account the appropriate extensions of their validity specified in the Special Act).
