Bike Accidents: Blaming The Bicyclist (May 24, 2017)

WHITEBOARD WEDNESDAY (MAY 24, 2017): The Bay Area is a very bicycle-friendly place, but with increased bicycle traffic comes increased car vs. bicycle accidents. These accidents don't usually end well for vulnerable bicyclists—and so the phone rings at our office... Now, we find that most of the time the car is primarliy at fault for the accident, but our injured clients are always surprised to learn that insurance company is inclined to BLAME THE BICYCLIST as a way of diminishing the value of the claim as opposed to humbly accepting responsibility for the loss.
