But what does that mean? What are the main points when discussing Environmental Law? The Federal Constitution states that everyone has the right to an ecologically balanced environment, a common good for the people and essential to a healthy quality of life. It imposes on the Government and the community the duty to defend and preserve it for present and future generations. The environment has diffuse ownership, as we are ALL entitled to this right. The environment may be on private property, but it belongs to everyone, as it is essential to a healthy quality of life. The Constitution also states that the Government and the community have the duty to defend and preserve it. In practice, this imposes responsibilities on the three branches of government: the Legislative, the Executive, and the Judiciary. The Legislative Branch cannot make laws in a retroactive manner. There is a principle that prohibits or prohibits regression, which means we must always seek to preserve the environment more, and never less. The Executive Branch must create public environmental policies through strategies for its protection and restoration. The community must be aware of preservation, and when something is wrong, it must take legal action through a Class Action or Public Civil Action. PRINCIPLES OF ENVIRONMENTAL LAW: Principle of Prevention This is the practice of preventing known, human-caused damage from affecting the environment, reducing ecological balance. Precautionary Principle This seeks to avoid certain actions on the environment, as there is no certainty that these actions will not cause adverse reactions. The difference between the principles of prevention and precaution is that the principle of prevention addresses known damage, while the precautionary principle avoids unknown reactions. Polluter Pays Principle The costs of environmental damage should be borne by those who generate the pollution. Those who engage in polluting activities should bear the costs of prevention or remediation measures. Protector-Recipient Principle Benefits should be created for those who protect the environment to encourage these initiatives. Principle of Responsibility In addition to repairing the damage, offenders who harm the environment are subject to criminal and administrative sanctions. Principle of Limits Government authorities must establish minimum standards for waste, noise, and particulate matter, among other things, aiming for sustainable development. Principle of the Social Function of Property Property must fulfill its social function, which includes ensuring a healthy quality of life for people. Principle of Cooperation among Peoples The environment has no borders. The Earth is a vast ecosystem, and the way to preserve it is through cooperation among nations. Principle of Intergenerational Solidarity There must be a pact between generations so that current generations preserve the environment for future generations.
