Gibbons v. Ogden | The Commerce Clause in Early America

#Law&History #gibbonsvogden Gibbons v. Ogden is the foundational case regarding the Commerce Clause and the Court’s jurisprudence toward it in early America. The case grew out of the Livingston/Fulton steamboat monopoly, which was granted to the that partnership by the State of New York. The monopoly sold licenses to others permitting them to operate steamboats in New York waters and across state lines. Eventually, this practice was questioned by Thomas Gibbons and the stage was set for the landmark case of Gibbons v. Ogden.
