You use Aadhaar everywhere. For banking, SIM cards, hospital registrations, government schemes, tax filings, and countless daily transactions. But does Aadhaar prove that you are an Indian citizen? The law says no. In a significant case now before the Supreme Court, a petition has challenged the widespread use of Aadhaar as proof of citizenship, domicile, residence, and even date of birth. The plea points to Section 9 of the Aadhaar Act, 2016, which clearly states that Aadhaar, by itself, does not confer or prove citizenship or domicile. Even UIDAI has repeatedly clarified that Aadhaar is primarily an identity document, not proof of nationality or legal residence. Acting on the petition, a Bench led by Chief Justice Surya Kant has sought responses from the Central Government, State Governments, and the Election Commission of India. The case raises a fundamental constitutional question: If Parliament has limited Aadhaar's legal scope, can authorities rely on it for purposes beyond identity verification? The petition also questions the use of Aadhaar in voter registration, welfare schemes, domicile verification, and other administrative processes, arguing that identity, citizenship, residence, domicile, and date of birth are legally distinct concepts that cannot automatically be established through a single document. Importantly, the Supreme Court has not made any findings on the allegations raised in the petition. It has only issued notices and sought responses from the concerned authorities. At stake is not the validity of Aadhaar itself, but the limits of its use. The Court's eventual ruling could have far-reaching implications for elections, government verification processes, welfare delivery, and the legal distinction between identity and citizenship. Can one document become proof of everything when the law says it is proof of only one thing?
