The decree of July 18, 2025, introduces procedural changes regarding ADR (Alternative Dispute Resolution). This is particularly the case with the conventional case preparation (conventional investigation) provided for in Articles 127 et seq. of the French Code of Civil Procedure (CPC). Therefore, be aware that Articles 127 et seq. of the CPC no longer refer to judicial mediation or judicial conciliation. The purpose of case preparation is to prepare the case for trial (to allow the case to "mature"). Indeed, while civil proceedings are traditionally initiated by summons, the case must then be investigated before it can be judged. More specifically, the decree of July 18, 2025, established conventional investigation as a new principle for case preparation. Thus, conventional case preparation can be implemented in two ways. This means that the parties can now, through a simplified pre-trial procedure or a participatory case management process, determine the legal issues to which they intend to limit the debate, among other things.
