January 6, 2025. Broward County, Florida. A 23-year-old woman — we'll call her Rosa — showed up at what appears to be a BSO facility with a check she said came in the mail. Officers detained her within seconds. What followed was nine straight minutes of questioning before anyone mentioned Miranda rights. That's not automatically a problem — courts don't apply Miranda to every detention. But when you've been told you can't leave, you're inside a law enforcement building, and an officer is asking you directly about a crime, that's the exact scenario courts look at when a defense attorney files a suppression motion. Under Miranda v. Arizona, the test is whether a reasonable person in that situation would feel free to stop talking and walk out. Rosa probably didn't. On the state side, the charge is uttering a forged instrument under Florida Statute 831.02 — knowingly presenting a fake or altered check with intent to defraud. That's a third-degree felony. Rosa's defense? She didn't know it was fake. The problem: she admitted she'd done this at least twice before and got a cut of the money each time. That pattern is what prosecutors use to knock out the "I didn't know" defense. The officer also flagged potential federal exposure — 18 U.S.C. Section 1341, mail fraud. If the organizer mailed those checks as part of a recurring scheme, every single mailing is its own federal count. The person who cashes the check isn't usually the main target.
