Why is Dr. Kizza Besigye's treason trial being pushed forward before key legal questions are settled? Fresh controversy has erupted after Besigye and his co-accused, Hajji Obeid Lutale, filed a new application seeking to halt the case entirely, arguing that their constitutional rights were violated through alleged abduction from Kenya, torture, illegal detention and public statements made by Chief of Defence Forces Gen. Muhoozi Kainerugaba which they say have already prejudged the case. The defence has questioned the speed at which the High Court is moving, especially after Justice Emmanuel Baguma appointed assessors and ordered the first prosecution witness to appear on June 11, despite several preliminary matters and constitutional challenges still pending. Lawyers led by Erias Lukwago, Frederick Mpanga and Ernest Kalibala insist that the trial is being rushed before outstanding issues are resolved. They argue that pre-trial procedures have not been properly concluded and that proceeding under such circumstances would undermine the accused's right to a fair hearing. In a dramatic development, the defence declared that it will not participate in the June 11 proceedings, maintaining that the court should first determine the pending applications and constitutional questions before hearing evidence. Besigye himself expressed confusion over whether pre-trial proceedings had ended, questioning why assessors were being appointed while key legal challenges remained unresolved. He later accused President Museveni of using the courts improperly and vowed never to surrender. Meanwhile, prosecutors say they possess audio recordings, videos, social media messages and other evidence linking Besigye, Lutale and Capt. Denis Oola to an alleged plot to overthrow the government.
