What is it for, and what are its rules? Today's video is a summary of the Jury Trial, with an overview of the procedures set out in the Code of Criminal Procedure. The Federal Constitution establishes the jury as an individual guarantee, granting it jurisdiction to try intentional crimes against life. As a fundamental guarantee, the institution of the jury cannot be eliminated from our legal system, not even by constitutional amendment, as it is a permanent clause. The intentional crimes against life that are brought before the Jury Court are intentional homicide, infanticide, aiding, inducing, or instigating suicide, and abortion. Intentional crimes against life, whether completed or attempted, are brought before the Jury Court (both completed and attempted crimes lead to a Jury Court trial). If there is a negligent crime against life, there is no Jury Court trial. Proceedings under the jurisdiction of the Jury Court develop in two phases, which is why we call them two-phase proceedings. The first phase, the preliminary phase, focuses on determining the admissibility of the charge. This phase begins with the filing of the indictment and ends with a ruling of indictment, dismissal, downgrading, or summary acquittal. A ruling of indictment occurs when the judge is convinced that there is sufficient evidence of perpetration and proof of the materiality of the crime (i.e., proof that a crime against life occurred). If the judge finds that the evidence of perpetration is absent or that the crime did not occur, he or she will issue a ruling of indictment. A ruling of downgrading occurs when the judge finds that any other crime occurred, but not a crime against life. A summary acquittal occurs when the judge acknowledges that the defendant committed the crime, but the conduct is covered by an exclusion of unlawfulness, such as self-defense, a state of necessity, strict compliance with a legal duty, or the regular exercise of a right. After the verdict, the second phase of the Jury Trial begins. This phase includes a preparatory stage (in which the parties indicate which witnesses they wish to bring to the court) and the trial itself. The Jury Trial is composed of a presiding judge from the People's Court and twenty-five jurors, of whom seven are selected at random to form the sentencing panel. It is the citizen, under oath, who decides on the crime. This jury's decision is based on their conscience. The jury answers questions about the materiality of the crime (whether the crime occurred), authorship (whether the accused committed the crime charged), whether the accused should be acquitted, grounds for mitigating and mitigating factors, grounds for increasing and qualifying factors, and so on. The jury's voting, when in the special room ("secret room"), must be strictly confidential. Voting is confidential.
