During the Delhi High Court’s Division Bench hearing in the Sonam Wangchuk matter, Solicitor General Tushar Mehta argued that while every individual ordinarily has the right to decide whether to undergo medical treatment and where to receive it, that right cannot be viewed in isolation when a protester’s deteriorating health could have wider law and order implications. Calling the bodily autonomy argument “attractive at first blush,” the Solicitor General submitted that the State’s constitutional obligation to protect life and maintain public order becomes relevant where a potential loss of life could have broader public consequences.
