Reasons for Amendment It is necessary to resolve the legislative gap in the criteria for imposing administrative fines under the Enforcement Decree of the Road Traffic Act, which lacks a monetary standard for illegal parking or stopping of motorcycles, etc. Therefore, this amendment aims to improve and supplement certain deficiencies observed in the operation of the current system, such as clearly stipulating the amount of administrative fines for illegal parking or stopping of motorcycles, etc. B. Main Contents Establishment of Administrative Fine Imposition Criteria for Illegal Parking or Stopping of Motorcycles, etc. (Draft Annex 6, Draft Annex 7) The amount of administrative fines for illegal parking or stopping of motorcycles, etc. is set at the same level as traffic violation fines and added to the imposition criteria. The imposition criteria are subdivided by zone: 30,000 won for general areas; 60,000 won for areas around fire facilities with safety signs and protection zones for the elderly and disabled; and 90,000 won for child protection zones. It is stipulated that for stopping or parking violations lasting more than 2 hours at the same location, an additional 10,000 won shall be added to the respective standard fines. 2. Until now, residents visiting natural recreation forest campsites and other areas using motorcycles have experienced inconvenience, being denied entry to parking lots and forced to park outside. In fact, grievance complaints were received regarding unfair restrictions on entry simply because the user was a motorcycle. Consequently, during the regular meeting of the Gyeonggi Provincial Anti-Corruption and Civil Rights Commission on May 21, the appropriateness of the ordinance regulations restricting motorcycle entry into natural recreation forests was reviewed. These parking restrictions stem from the "Gyeonggi Provincial Ordinance on the Management and Operation of Natural Recreation Forests," which stipulates the restriction of entry and the order to evict motorcycle users. The Forest Environment Research Institute restricted parking based on this provision, but the Commission's investigation revealed a high likelihood of conflict with higher laws. The "Parking Lot Act" prohibits the refusal of parking lot use without justifiable grounds, and the "Act on Forest Culture and Recreation" also only prohibits entry onto forest trails within recreation forests, lacking a clear basis for restricting access to attached parking lots. Consequently, the Commission determined that the ordinance's restriction on motorcycle parking, which is guaranteed under the Parking Lot Act, constitutes excessive administrative action. It was recommended that the ordinance be amended to allow, in principle, the passage of two-wheeled vehicles to designated attached parking lots, viewing this as a legitimate right to use public facilities. At the same time, to maintain safety and order within recreational forests, it was recommended that the enforcement rules of the ordinance clearly specify the conditions for permitted operation of two-wheeled vehicles and establish grounds for sanctions in case of violations.
