It has been reported that the police will not refer Ms. A to the prosecution, in accordance with internal guidelines that refer cases involving the cultivation of fewer than 50 poppy plants to summary judgment. For minor offenses punishable by a fine of 200,000 won or less, criminal procedures can be simplified, allowing for a summary trial upon the request of the police chief. Among poppies, there are narcotic poppies and ornamental poppies, and it is difficult to distinguish between the two before they bloom. When the poppies subject to enforcement bloom, large black or purple spots become visible. However, because it is difficult to determine whether a plant is subject to enforcement based solely on the appearance of the flower buds, stems, or fruits, judgments sometimes differ among investigative agencies. Narcotic poppies contain narcotic substances such as morphine, codeine, and papatherine, so their cultivation is strictly prohibited in Korea. If one cultivates a plant knowing it is a poppy, they may face imprisonment of up to five years or a fine of up to 50 million won. The police advised that at this time of year, poppies are easily spread by the wind and sometimes bloom naturally in vegetable gardens or flowerbeds, urging the public to report any suspected poppies.
