STATE RECOGNITION IN INTERNATIONAL LAW|THEORIES |KINDS DEFACTO AND DEJURE RECOGNITION . Definition: Prof. L.Oppenheimn _ In recognizing a State as a member of International community, the existing States declare that, in their opinion, the new state fulfils the conditions of statehood as required by international law". [ ] THEORIES 1. CONSTITUTIVE THEORY • The chief exponents of this theory are Hegel, Arzilloti, Holland, Oppenheim etc. • According to this theory, recognition alone creates statehood and clothes the recognised state with rights and duties under International law. • It is a process by which a political community (state) acquires International personality by becoming a member of the family of Nations Only by recognition, a State becomes a participant. Supporting this theory, Holland says, "A State cannot be said to have attained maturity unless it is stamped with the seal of recognition, which is indispensable to the full enjoyment of rights, which it connotes." 2. Declaratory Theory • The Chief exponents of this theory are Hall, Wagner, Brierly, Pitt Cobbet and Fisher. • According to this theory, statehood or authority of a new Government exists prior to recognition. • Recognition according to this theory, is a mere formal acknowledgement or admission of an already established fact. • In other words, the exponents of this theory maintain that recognition merely has a declaratory, not a constitutive effective. • Recognition does not bring into existence a State, which did not exist before. In simple words, recognition of a State is formal and has legal effect. • Brierly-state may exist even without recognition DEFACTO RECOGNITION: De facto Recognition: • De facto recognition' literally means according recognition to a new State, which is independent, but has not gained sufficient stability so as to be able to fulfil international obligations". • It is provisional and is liable to be withdrawn in the event, the State is found incapable of fulfilling the international obligations. According to Prof. G. Schwarzenberger, "when a State wants to delay the de jure recognition of any State, it may in the first stage grant de facto recognition" De jure Recognition: • De jure is a Latin term, which means lawful of legally or by right. • De jure recognition is granted, when the State or Government possesses all essential requirements of statehood and it is capable of being a member of the International Community According to Prof. H.A.Smith, there are three conditions (conditions precedent) required to be satisfied for grant of de jure recognition as per the British practice, namely, a) a reasonable assurance of stability and permanence; b) the government commands the general support of the population; and c) it is able and willing to fulfil its international obligations. De jure recognition is accorded/granted, if the State or Government fulfils the test laid down by International law for effective participation in International community. This necessitates the exchange of diplomatic representatives and naval statutes between worships.
