Travel Cancellations Due to War Situations: Rights and Advice In this new video, we'll explain how and when to cancel a trip or flight, your rights, and put them in context with the current situation in different destinations. All the information and much more is available on the LosViajeros.com forum, in this thread about Cancellations and Safety in the Middle East: https://www.losviajeros.com/foros.php... ✈️ Travel Cancellations Due to War Situations: Passenger Rights, Legislation, and Recommendations In a world where the use of violence seems to be becoming more frequent, our travels are more likely to be affected by armed conflicts, wars, or serious situations of political instability that can directly impact our international trips. In these cases, passengers have a series of rights recognized by European and national legislation, when they have not booked directly with local companies. 1. Applicable Legal Framework You can find all the links in an article published on LosViajeros.com, and here's the link: https://www.losviajeros.com/noticias.... 2. Cancellation of Package Tours A package tour is one that includes at least two tourist services booked together, such as: • Flight + hotel • Flight + organized tour • Transportation + accommodation + excursions In certain cases, the traveler has the right to: • Cancel the trip without penalty. • Receive a full refund of the amount paid. • Obtain the refund, usually within a maximum of 14 days. However, it's important to note that in these situations, there is usually no right to additional compensation, as the cause is not the responsibility of the agency or the organizer. 3. Flight Cancellations Due to War or Armed Conflict If an airline cancels a flight due to war or security-related reasons, the passenger has the right to choose between: • A full refund of the ticket. • Alternative transportation as soon as possible. • A change of date under similar conditions. In this case, the airline may offer a voucher or a change of date, but acceptance is always optional and voluntary for the passenger. Under normal circumstances, the regulations also stipulate financial compensation of between €250 and €600 depending on the flight distance. However, when the cancellation is due to extraordinary circumstances—such as war, terrorism, or airspace closures—the airline is not obligated to pay this additional compensation. 4. Cancellation by the Traveler If there is an officially recognized war or armed conflict at the destination and it is considered an extraordinary circumstance, the traveler may cancel without penalty for package holidays. 5. Cancellation by the Travel Agency Travel agencies or tour operators can also cancel a trip if they cannot guarantee the safety of travelers or the proper provision of services. In these cases, they must: • Inform the traveler as soon as possible. • Offer a similar alternative trip when possible. • Refund the full amount paid if the client does not accept the alternative. Regulations stipulate that the organizer must act diligently and prioritize the safety of travelers. 6. Cancellation and Assistance Insurance Travel insurance can be a fundamental tool for protecting travelers in unforeseen situations, but less so in situations of war or conflict. However, policies usually include non-liability coverage in cases of: • Terrorist attacks. • Armed conflicts. • Emergency evacuations. 7. Official Travel Recommendations In the case of Spain, these recommendations can be found at: Ministry of Foreign Affairs – Travel Recommendations When the government explicitly recommends against travel to a destination, this is usually considered an extraordinary circumstance that allows for penalty-free cancellation of package holidays. It is important to emphasize that there must be a "Do Not Travel" recommendation (for example: Iraq, Lebanon, Iran, Syria, Israel...), however, this recommendation does not exist for other countries (such as Egypt, Morocco, Tunisia, or Jordan), meaning there is no legal reason to cancel the trip. 00:00 Start 00:30 Security Risks 03:06 Cancellation of Package Tours 04:28 Flight Cancellations 06:06 Traveler Cancellations 06:58 Cancellations by the Agency 07:51 Cancellation Insurance 08:54 Official Recommendations 10:11 Cancellations due to Conflicts 11:14 Practical Advice 11:54 Middle East Conflict 13:40 Egypt 13:50 Turkey 14:07 Jordan 15:11 Final Recommendations
