Generally, the first residence permit (under the General Regime) is usually valid for one year, after which it is renewed for a period of two years, and then for another two. Once five years of legal and continuous residence in Spain have been completed, the foreigner can apply for Long-Term Residence Permit, provided they meet the established requirements. In certain cases, and when specific requirements for obtaining this Long-Term Residence Permit are not met, it is possible to apply for an extraordinary renewal of your Residence Card. LONG-TERM RESIDENCE PERMIT AND EXTRAORDINARY RENEWAL The long-term residence permit grants foreigners the right to reside and work in Spain under the same conditions as Spanish citizens, indefinitely. For this reason, it is known as a "permanent residence permit." The requirements for obtaining the Long-Term Residence Permit are simple: you only need to have resided legally in Spain continuously for five years, without needing to demonstrate sufficient financial means or a minimum contribution period, etc. In other words, unlike temporary residence permits, the only verification is that you have resided legally and continuously in Spain for the previous five years. Therefore, the relevant Immigration Office will verify that the applicant has not exceeded the permitted period of absence from Spain. Specifically, you must not have been outside of Spain for more than six months in any one-year period, or the total number of absences from Spain must not exceed ten months within the last five years. If the absence is for work-related reasons, the total number of absences cannot exceed one year within the required five-year period. So, what happens if, when we apply for long-term residency, we realize that we have been outside of Spain for more than 10 months in the last five years? Would we be denied renewal? Would we become undocumented? These cases are quite common, but to prevent foreigners from becoming undocumented for failing to meet one of the requirements for long-term residency—in this case, the period spent outside of Spain—immigration regulations allow for the possibility of requesting an extraordinary renewal of your residency card. An extraordinary renewal allows foreigners, exceptionally, to renew their residency permit again, provided they meet the requirements for a standard renewal (employment, self-employment, etc.). In other words, this extraordinary renewal will take into account prior social security contributions, having an employment contract, and all other requirements and conditions stipulated for renewal, whether for employed or self-employed individuals. Once it is verified that you meet the requirements, as if it were a normal renewal and not a long-term one, a new authorization will be granted with a validity of two years. In this way, the foreign national would again have the opportunity to meet all the requirements to obtain Long-Term Residence Authorization, including, of course, not exceeding the permitted time outside of Spain. In short, a third renewal of your permit would be granted, exceptionally, to maintain your legal and continuous residence and thus provide another opportunity to obtain Long-Term Residence Authorization in Spain.
