Although legal explanations and statutes are readily available, actually writing a will can be confusing and unsure of how to do it correctly. In this video, I'll use a simple tool: an iPad and a blue pen to write the word "will" on the document and detail each section in detail to provide a clear understanding of the steps. Before starting to write a will, the first thing you should do is: "Reviewing the law," particularly Section 1657 of the Civil and Commercial Code, which states that the testator must write the entire will by hand, including the text, date, month, year, and signature. Importantly, witnesses are not required for this type of will. However, if any part is erased, scratched out, crossed out, or altered, a signature is required to accompany each amendment to prevent the altered will from being invalidated. In addition to understanding the law, preparing information before beginning writing is crucial. I recommend creating a "checklist" in advance so that you don't forget any important information when you begin writing. Items to prepare include: (1) your full name, ID card number, and address; (2) details of assets, such as the title deed number for real estate, bank account information (account number, account name, bank), car details (make, model, registration number), and other personal assets such as stocks, mutual funds, or valuable collectibles; (3) information of the heir, which should clearly state the full name, ID card number, relationship status, and address; and (4) information of the estate executor. This is the person who will have the authority to manage and execute the will after our death; (5) details of debts (if any) to enable the executor to properly pay them; and (6) a statement specifying the bequest of all other assets not yet clearly specified, to whom they will belong, or in what proportion they will be distributed. If this is not specified, ambiguity may arise, requiring subsequent interpretation under civil and commercial law. Once you have prepared all the information, it's time to write it. You can use plain paper and a blue pen (or any other color, but it should be clearly visible). Begin with the word "Will," specify the date, month, year, and the phrase "This is the last will." Then, write the testator's full name and information from the "checklist" you have prepared, such as which assets are bequeathed to whom, the designation of an executor, and a statement that all previous wills (if any) are void. This ensures that this will has superior force over the others. After completing all the details, don't forget to sign the will and date it to confirm its validity. If you have final instructions regarding funeral or other ceremonies, you may write them in a separate document. Alternatively, you can write them in the same will, but make them clear so that all parties involved can easily understand them.
