CONSEQUENCES OF THE "AUTOMATIC" APPLICATION OF ARTICLE 94 OF THE CIVIL CODE – THREE REAL CASES – On September 3, 2021, Law 8/2021, of June 2, came into force. This law reforms the civil and procedural legislation to support persons with disabilities in the exercise of their legal capacity. This law amended, among other things, Article 94 of the Civil Code, which provides that the mere filing of a complaint for gender-based violence is sufficient to prevent the establishment of visitation arrangements or, if they exist, to suspend them. More than three and a half years have passed since this law came into force, a more than sufficient period of time—in my opinion—to assess its application.
