This was confirmed on October 22nd 1993 in the case of Time Warner Entertainments Company Lp v Channel 4 Television Corporation PLC and Fabula Films Ltd (EWCA Civ J1022-5). The Laws of fair dealing in the UK include all elements within a film clip, including the soundtrack. There is no legal requirement to secure the permission of the copyright holder for the use of these clips; indeed, the copyright holder is not able to refuse permission for usage under fair dealing rules. Any copyright claim against this documentary is, therefore, without legal standing under the 1988 law and the 1993 precedent.
