The main arguments that we used in court and with which the appellate court agreed: -the application form signed by the defendant, in addition to the latter's personal data, does not contain any data on the terms of the loan, in particular regarding the amount of interest, penalties and commissions; -the amounts paid by the defendant to repay the interest debt by the bank must be taken into account when determining the amount of the loan actually received by her; -in the absence of agreement between the parties on the amount of interest, the bank had no right to either charge it at the rates determined by it, or to credit the defendant's funds towards their repayment; I remind you that in this case the decision of the court of appeal is final and cannot be appealed.
