You have seen the commercial. A man in a wide western desert holds up a piece of ore in the sun. He tells you it is worth five hundred dollars in his palm. He tells you land out there is still free. Minerals still there. That a regular man can walk onto federal ground on a Tuesday morning, drive a four-foot wooden post into the dirt, pay under a thousand dollars in paperwork, and legally take every ounce of silver or gold underneath. That the General Mining Act of eighteen seventy-two says so. One hundred and fifty-four years old. Still on the books. Today. I found it. And here is what most folks get wrong about the law. Most folks hear General Mining Act and they picture a man with a pickaxe and a mule going after a vein of silver. That is what the law was written for. And that is what the corporations that abuse it today count on. Because as long as you are staring at the ground and thinking about what is underneath, you are not thinking about what is on top. And what is on top of any acre of American land is worth more, in a single lifetime, than any silver claim ever pulled out from under it. The wealth is not underneath the ground. It is on top of it. The word for what is on top of the ground is topsoil. And your family has been standing on it the whole time. My grandfather was born in nineteen twelve. When he was a boy, the newspaper in Lancaster ran an advertisement every spring for men who wanted to head west and try their hand at a silver claim. Some men from our county went. A few came back with a small pouch of dust. Most came back with nothing. And one came back in a pine box. My grandfather stayed on this same forty acres. He worked the topsoil his own father had cleared. He built five children out of that ground. He built a barn, a smokehouse, an icehouse, and the indoor washroom he finished in nineteen forty-eight. When he died at eighty-three, he owned every inch of what he stood on, and he had never once picked up a wooden post to drive it into a hillside.
